sfpd_arrestcuffs.jpgSan Francisco prosecutors on Wednesday declined to file murder charges against a man arrested in connection with his domestic partner’s death at their Mission District apartment earlier this week.

Oliver Carter, 32, was found dead inside an apartment in a residential hotel in the 400 block of Valencia Street just before noon on Monday, according to police.

Carter’s partner, 53-year-old James Warren, was arrested on suspicion of murder later the same day. He was booked into jail under the name Joseph Warren.

Police spokeswoman Lt. Lyn Tomioka said the couple had been arguing and Carter apparently fell and hit his head during a struggle.

District attorney’s office spokesman Seth Steward said today that his office has declined to file murder charges in the case, pending further investigation. The office did not release further details.
