A San Francisco Superior Court judge on Tuesday ordered a 22-year-old man to stand trial for the murder of another man in the city’s Bayview District in August, according to the district attorney’s office.

At the conclusion of a two-day preliminary hearing, Diante Johnson was held to answer for the fatal shooting of 23-year-old Marquez Benson, and the shooting of another man who survived, on Aug. 27.

The shootings occurred at about 9 a.m. in front of 8 Matthew Court.

Police found Benson lying on the sidewalk, covered in blood. He died later at the hospital.
The surviving victim told police that while he and Benson were sitting inside Benson’s car, a man wearing a knit cap approached the car, took out a handgun and started shooting into the vehicle, according to the district attorney’s office.

Johnson, a parolee who was living in Daly City, was arrested by the U.S. Marshals Service in September in Ogden, Utah.

At the preliminary hearing, the surviving victim identified Johnson as the shooter, according to the district attorney’s office.

Johnson will be arraigned Feb. 9 on charges of murder and attempted murder.
