A man who stands accused of a brutal Bernal Heights beating that led to one man’s death won’t be facing a trial or jail time, a judge decided Wednesday.
59-year-old Sherman Brown was brutally beaten on the 400 block of Prentiss St. in Bernal Heights on March 22, when police say an argument between Brown and 32-year-old Anthony Pacrem turned physical and Pacrem punched kicked Brown until he blacked out.
Brown was taken to a hospital, where he succumbed to his injuries on May 3.
Pacrem was found and arrested on suspicion of aggravated assault, but those charges soon changed to murder after prosecutors discovered that Brown had succumbed to his injuries.
As previously reported, the case was delayed over 17 different times as Pacrem underwent psychiatric evaluation.
However, Pacrem never appeared in court, since he was being held for psychiatric evaluation at a hospital. His defense attorney, Matthew Rosen from the public defender’s office, has said Pacrem has a long history of mental illness.
Now, a judge has ruled that Pacrem has been deemed incompetent to stand trial.
A hearing will be held Oct. 15 to determine which state hospital will house him.
