I was told that 8 votes are necessary to pass Daly's proposal because the budget that was passed contained the cuts that are about affect SEIU employees. Un-doing cuts that have already passed needs a 2/3 majority.
At any rate, since the Mayor would probably veto it, 8 votes would may be needed anyway.

The City Attorney would agree with you, Melissa, but Chris Daly would not. Peep the letter, linked in the story, for his take on it.
And yes, eight are needed to override a veto, but this begs the question -- if Sacramento votes DPH money to save jobs, and it's DPH's money, not anyone else's, why would Mistermayor then override Sacramento's doing? Not saying he will or he won't -- I have no idea, as usual -- just putting it out there.

Oh, I saw the letter. And talked with Daly, but David Chiu agreed with the City Atty at today's meeting. Luckily for Chiu, the vote on the $7.5 million was postponed because they got 8 votes to pass about $2 million to get through the holidays - making it a moot point for now.
Problem is, even the most optimistic estimate (from the SEIU) is that the money will come in April. And it's not clear to me whether that money goes straight to DPH or to the general fund. At any rate, by that time, we'll be well into dealing with next year's budget - and Mistermayor is likely to use it to pay for stuff in FY 2010-2011 - DPH stuff, perhaps, but not to save the jobs at issue now.
