5:28 PM:A San Pablo man will be arraigned Tuesday morning on murder and multiple weapons and drug charges for the alleged hit-and-run death of a 21-year-old man Friday in the San Francisco’s North Beach neighborhood, prosecutors said today.
The 2:20 a.m. crash at Columbus and Vallejo streets left Luis Armando Prieto, of San Francisco, dead. Prieto had been walking with his brother at the time. The crash followed a shooting a few blocks away in the 500 block of Broadway.
District attorney’s office spokesman Brian Buckelew said today that the Nissan Maxima seen leaving the shooting struck Prieto at 70 mph and had its headlights off.
The driver, Oscar Alejandre, 21, of San Pablo, was arrested following the crash and appeared in San Francisco Superior Court this morning on a separate firearm case.
Buckelew said his office decided late this morning to charge Alejandre with second-degree murder.
Prosecutors also charged him with gross vehicular manslaughter, negligent discharge of a firearm, hit-and-run causing death, possession for sale of methamphetamine, transportation of methamphetamine, possession of methamphetamine while armed with a firearm, carrying a concealed firearm, carrying a loaded firearm–all felonies–and misdemeanor counts of resisting arrest and driving on a suspended license.
“If you are involved in a shooting and then kill someone as you attempt to flee, that is not a traffic accident, it is murder,” District Attorney Kamala Harris said in a statement this afternoon.
Bail was set this morning at $100,000 on Alejandre’s previous case, two misdemeanor charges for alleged possession of a gun at a parking lot at 530 Broadway, the same location of Friday’s alleged shooting.
Alejandre remains in custody and is scheduled for arraignment on the new charges Tuesday morning.
Two others are also charged in the case.
According to police, Alejandre, Fidel Bejarano, 24, of Hercules, and Andrea Luna, 22, of Richmond, had been at a nearby North Beach strip club on Friday night.
Police were called to the parking lot at about 2:15 a.m. and were attempting to break up a fight when they heard gunshots nearby. No injuries were reported.
The circumstances surrounding the shooting are still under investigation.
Officers then saw a gray Nissan Maxima speeding from the area with its lights off, police said.
Following the car, officers saw it strike something at Vallejo and Columbus streets and then continue on, police said. Officers realized a pedestrian had been hit and called for assistance.
The Maxima was found abandoned, with front-end and windshield damage, several blocks away in the 600 block of Lombard Street, and Alejandre and Bejarano were arrested nearby, police said.
According to police, a handgun was found inside Luna’s purse in the car. She was arrested later in the morning.
Two other guns were recovered, one near the car and another where the shooting took place, police said.
Prosecutors today charged Bejarano, who they said was a passenger in the Maxima and also fired a gun on Broadway, with negligent discharge of a firearm, possession for sale of methamphetamine, transportation of methamphetamine, possession of methamphetamine while armed with a firearm, being a felon in possession of a firearm, carrying a concealed firearm in a vehicle, carrying a loaded firearm and misdemeanor resisting arrest.
Luna was charged with possession for sale of methamphetamine, transportation of methamphetamine, possession of methamphetamine while armed with a firearm, carrying a concealed firearm in a vehicle and carrying a loaded firearm.
Bejarano and Luna are also scheduled for arraignment Tuesday morning.
In 2009, Alejandre was acquitted of first-degree murder in Contra Costa County for an alleged fatal drive-by shooting of another man in San Pablo in 2007.
Prosecutors there said they were able to get Alejandre’s alleged accomplices to testify against him at trial, but the jury found there was not enough corroborating evidence to justify a guilty verdict.
