Attorney For BART Shooting Cop Wants Murder Charge Thrown Out

Protests may soon return to Oakland's streets. The Examiner reports that defense attorney Michael Rains intends to present a motion later today to throw out the murder charge against Johannes Mehserle.

Meshire is infamous for his "accidental" shooting of Oscar Grant on New Year's day in the Fruitvale Bart Station. Rains argues that Mehserle intended to use his stun gun and that there is not sufficient evidence for a murder charge.
