San Francisco police are trying to determine whether charges should be sought in connection with a shooting in the city’s Bayview District Tuesday night in which the shooter may have acted in self-defense, a police spokesman said today.
The shooting was reported at 8:38 p.m. Tuesday after the 28-year-old who was shot was allegedly kicking over several garbage cans in the 1100 block of Gilman Avenue, police spokesman Sgt. Mike Andraychak said.
A 32-year-old man in one of the homes along the street yelled at the other man, who appeared to be intoxicated and was with two small children, Andraychak said.
The man in the street then left with the children, but returned about 10 minutes later and became argumentative, according to Andraychak.
The father of the 32-year-old then apparently confronted the unruly man outside the garage door of the home, and when he saw the man reach toward a dark-colored object in his waistband, the father fired one shot at him, striking him in the stomach, Andraychak said.
The man walked away and collapsed in a neighbor’s garage before getting up. He was found by police on the sidewalk, while officers found bloody clothes and a handgun in the garage where he had collapsed, Andraychak said.
The man was taken to San Francisco General Hospital with injuries that were initially considered life-threatening, but Andraychak said he is now in stable condition.
The shooter, a 67-year-old man, waited for police to arrive and cooperated with their investigation into the incident, handing over the gun used in the shooting, Andraychak said. He is not being named because he was not arrested.
The case remains under investigation, with police trying to determine whether the gun found in the garage was possessed by the 28-year-old, and whether the 67-year-old was justified in shooting to defend himself, Andraychak said.
“Once they can conclude the investigation, we’ll consult the District Attorney to see if charges should be filed,” he said.
