gavel.jpgA 39-year-old homeless man accused of murdering another transient in San Francisco by setting him on fire early one morning in November 2005 was found not guilty by reason of insanity today.

Scott Darden Kinney was accused of dousing 43-year-old Johnell Kirk Jr. with gasoline and lighting him on fire at about 4 a.m. on Nov. 1, 2005, as he slept in the 200 block of Beale Street.

Kinney agreed this afternoon in San Francisco Superior Court to withdraw an earlier plea and plead guilty to murder.

Judge Charles Haines then found Kinney not guilty by reason of insanity, based on reports from three court-appointed doctors that Kinney suffers from schizophrenia.

He will now be sent to a state mental hospital.
